- Are my arrest records public documents?
Clients often worry that even if they get cleared of all charges, their arrest record will still be a public document that a potential employer could see. Unfortunately, Florida criminal history records are public unless the record is sealed or expunged. A criminal history record is created when a person is arrested, and includes the disposition of the arrest, whether it is a conviction, acquittal, dismissal of charges before trial, or other disposition. With certain cases, we are able to work with clients to have their criminal records sealed or expunged. - How long will my criminal law case take?
The nature and complexity of the crime you are being charged with can affect the trial time.If your case is going to trial, the amount of time it will take you to go to trial depends on whether you are being charged with a felony (a more severe crime) or a misdemeanor (less severe crime). If you are being charged with misdemeanor cannabis possession, for example, Florida criminal law gives you the right to a jury trial within 90 days of the charge. For a felony marijuana charge though, it may be six months to a year before your criminal law case goes to trial. - Do I need a lawyer at my arraignment? Yes, which is why it is important that you hire an attorney before the arraignment.Although a fairly straightforward process, the arraignment is an important legal proceeding in which a defendant will submit their first plea. No matter how small a crime may seem, it is critical that an attorney is present to advise you at this stage of your criminal law case. An arraignment may involve some complex steps or matters that may require a defense lawyer’s experience to effectively protect your rights. An attorney may also be able to convince the court to lower your bail or have you released on your own recognizance without paying bail.
- Will my lawyer be honest with me about the likelihood of getting a “not guilty” verdict?
