Questions You May Have About Your Criminal Trial

I’m Steve Kramer of the TK Law Firm. I’m a Florida criminal defense attorney. And today we’re going to be talking about questions criminal defendants have about trial. The first question most people have is “Should I go to trial?” And there’s no simple answer to that because every case is different. We’ve got to look at the whole picture here because you need to know what kind of options are on the table. If you’ve got a great plea offer that avoids really serious consequences and if you went to trial you could be facing things like years in prison, then we’re going to have to weigh that very heavily. It’s ultimately going to be your decision but you need to have good guidance about what your chances are at trial, what’s going to happen. There’s other factors, too. You might have an opportunity to do what’s called “pre-trial diversion” which is where instead of doing a plea negotiation or going to trial, you complete some classes in education and all the charges get dismissed. So this is something that we want to look at on a case-by-case basis. The other question people have is “Should I testify at trial?” And that’s kind of the same thing, it’s case-by-case basis. It depends on you. Maybe you’re very articulate; you’re great in front of a jury, you don’t get nervous when you testify. You’ve testified many times before. Maybe that’s you. Or maybe not. Maybe you get very nervous and you’re worried about not being as credible…as a witness in testifying. Or maybe you gave some statements before that can be used against you. Maybe some confessions or you made some inconsistent statements and the State Attorney can paint you in a light that isn’t really going to benefit your case. The bottom line is each of these questions are something that needs to be looked at on a case-by-case basis. There’s no one size fits all. Why am I telling you this?
