What We Look for in A Foreclosure Case

I’m Steve Kramer of the TK Law Firm. I’m a Florida foreclosure defense attorney. And today we are going to be talking about what we as attorneys look for in a foreclosure case. The first thing we want to know is when was your last payment? How long have you been in default? That can matter, because we want you to have the best options down the road. We want you to be able to keep you r house if that’s what you want. We want keep you from owing money if what you want to do is get out of your house. And if you want time, we want to keep you in your house for as long as possible. And that’s something we need to know. The other thing we want to look for and when you come and fill out our intake paperwork is we want to know what happen when that loan was made. Was there fraud? Did the broker contact you? Did the appraiser fib on the numbers? We want to know about the fraud in making the loan. We want to know if this was what they call a predatory loan, where just the circumstances don’t feel right. Something doesn’t smell right and it doesn’t pass the smell test. The other thing we want to know is if there has been an attempt to negotiate a resolution. Have you been working with the bank to get something done? Have you been trying to do a short sale? Have you been trying to do a modification? What have you been trying to do? Because that matters, if you have been trying to and the bank hasn’t, then that going to be an issue in your case. And the other thing we want to know finally is…. your ultimate goal. What do you want out of this? Do you want to keep the house? Do you want to stay in the house for as long as possible? Or do you just want to get out of it without owing money? And we need to know that because ultimately our goal is to meet your goal. And then one more thing that we really want is reasonable expectations. You can find a million people out there that will promise you anything until they get your check. That’s not what we want; we want you to have reasonable exceptions. We always want to under promise and over deliver so that you are happy with the service we provide you. And that’s really, really important to me when I take in a client.Why am I telling you this?
